1. Purpose

These General Terms and Conditions of Sale (GTCS) define the rights and obligations of SARL FCR (custom-built motorcycle design and sales workshop) and any customer (professional or private) ordering a new, restored or customized motorcycle.

2. Scope of application

These GCS apply exclusively to the creation, restoration, customization and sale of motorcycles by SARL FCR, whatever the channel (paper quotation, website, electronic exchanges). Any condition to the contrary imposed by the customer is unenforceable unless agreed in writing.

3. Services and products

• 3.1. Custom design : design and manufacture of motorcycles to customer specifications.
• 3.2. Catering : reconditioning of vintage motorcycles, aesthetic and mechanical restoration.
• 3.3. Motorcycle sales : new or restored motorcycles, as is or customized.
• 3.4. The technical characteristics, visuals and descriptions given in the quotations are indicative; the customer accepts any necessary adaptations.

4. Customer’s obligations

• 4.1. The customer warrants that he/she is of legal age and capacity.
• 4.2. It provides all the necessary information and documents (technical choices, regulatory constraints, aesthetic preferences).
• 4.3. Any changes to the project must be notified in writing.

5. Quotation, order and cancellation

• 5.1. Free quotes, valid for 30 days.
• 5.2. Order validated by signed quotation and 40% deposit.
  • 5.2.1. Order form : the project does not start until we have received the signed order form and the deposit.
  • 5.2.2. BAT (Bon À Tirer) : work started after validation and signature of the proof of concept.
• 5.3. Cancellation :
  • Production motorcycles: possible within 48 hours if not manufactured or shipped.
  • Tailor-made services: non-cancellable after signature.
• 5.4. The right of withdrawal does not apply to customized services.
• 5.5. No right of withdrawal for business customers.
• 5.6. SARL FCR may refuse or cancel an order in the event of non-payment or dispute.

6. Prices and payment terms

• 6.1. Prices include VAT, but exclude shipping and certification costs.
• 6.2. Deposit at time of order: 40%.
• 6.3. Balance before delivery or availability.
• 6.4. No discount for early payment.
• 6.5. Payment methods: bank transfer, credit card, cheque.
• 6.6. Late payment: penalty = 3× legal rate (art. L441-10 C. commerce).
• 6.7. Flat-rate indemnity of €40 for collection costs (business customers).

7. Transfer of ownership and risks

• 7.1. Ownership transferred upon full payment.
• 7.2. Risks transferred upon delivery or availability.
• 7.3. Delivery in the workshop or to the agreed address.
• 7.4. FCR is not responsible for delays related to subcontractors or parts.

8. Warranties

• 8.1. Legal warranty of conformity: 2 years.
• 8.2. Warranty for hidden defects: 2 years after discovery.
• 8.3. Warranty valid only if assembled by an authorized professional.
• 8.4. Commercial warranty (optional): 12 months (parts + labor).

9. Liability

• 9.1. Obligation of means.
• 9.2. No liability for use of non-approved vehicles.
• 9.3. Liability limited to the invoiced amount.

10. Intellectual property

All elements (texts, images, plans, etc.) remain the exclusive property of SARL FCR. Reproduction prohibited without written authorization.

11. Personal data

RGPD compliance. Right of access, rectification and deletion via: contact@fcroriginal.com

12. Force majeure

Events defined in article 1218 of the French Civil Code. Suspension of contract. Termination possible if situation lasts longer than 3 months.

13. Disputes

• Attempt at amicable resolution.
• Applicable law: French law.
• Jurisdiction : Commercial Court of Poitiers.

14. General provisions

• 14.1. Partial nullity: the other clauses remain valid.
• 14.2. Terms and conditions may be modified at any time. Applicable version: the one in force at the date of the order.
